interspousal grant deeds for Real Estate Property

One spouse is awarded real estate property pursuant to a court order from either a litigated judgment or marital settlement agreement. The process is not complete until actual title of ownership is changed in the public recorder. The non-owning ex-spouse transfers his or her interest to the owning spouse.

Transfer of ownership is by quit claim deed also known as an inter-spousal deed. To make the transfer a court order is needed. Often the transferring spouse is not comfortable signing of ownership interest until the judgment is obtained or the transfer document is overlooked or omitted from the judgment package. If the transfer deed has not been prepared at the time of judgment, it can be done any time after entry of judgment.

Deed and Record provides the documentation needed to complete the court order. Deed and Record files these documents with the appropriate government agency so the ownership change is on the public record.

Californias Recording System

California maintains ownership records by county. Each County in California is responsible for knowing who owns each and every real estate property within the boundaries of that County. The interspousal grant deed is filed with the County Recorders office.

Intersposual deeds in California are exempt from transfer tax and property tax base increase. The grant deed needs on its face a reference to the California tax law that exempts the deed from a transfer tax. The Preliminary Change of Title Report provides information to establish why the transfer is exempt from an increase in the property tax base. Deed and Record provides the transfer tax exemption law reference and the Preliminary Change of Title Report.

Hawaiis Recording Systems :

Hawaiis recording systems are complex. Documents are recorded either in the Land Court system, Regular system or both. When recorded in both land systems, documents are said to be recorded in the Double system. Deed and Record provides service to both the Land Court and the Regular System .

Interspousal deed transfers are exempt from transfer tax. But the exemption must be requested on a document Form P-64B Exemption from Conveyance Tax. Deed and Record prepares both the deed and Form P-64B.

Any real estate property recorded in the Land Court requires a Petition to the Land Court to recognize the divorce or dissolution of marriage. Hawaii no longer allows timeshares in the Land Court. Timeshares currently in the Land Court are removed as title is changed. This requires decertification of the timeshare. Deed and Record prepares the documents needed for the Land Court.

Add or Remove Joint Tenant

If real property is held in joint tenancy, upon the death of a joint tenant, the deceased joint tenants interest disappears and the survivor has sole ownership. The county recorder must be notified of the death and the public records updated. This is done with an affidavit death of joint tenant. California Vacation Rental Business Booming

Cedar Creek Realty, a vacation rental and property management company in Arnold, California reports that vacation rentals are being snapped up in the area.

“This was the best July we’ve ever had. It was record numbers for us,” said Kelley Stellar, vacation rental manager for Cedar Creek Realty in Arnold. “Many people who used to take their vacations to Hawaii, Europe or Tahoe are coming up to the Arnold area these days.”

Stellar believes this is partly due to the poor economy and partly due to the recent “discovery” of the Arnold area by young families in the East Bay of California’s San Francisco Bay Area.

Stellar estimates there are between 150 and 300 vacation rentals available in the greater Arnold area. Renters often just stay for the weekend, but week- and month-long stays are becoming increasingly common.

From a business perspective, experts believe that turning a second home into a vacation rental is a good way to supplement income. “It’s a great idea in this point in time,” Stellar said. “All of my rentals are second homes. Now, because of the economy, they have decided to rent them out for extra income.”

Stellar said that along with the booming rentals, home sales are also up in the area. “We get people who actually are up here looking to purchase a home to put it in a vacation rental program. They know that now is a good time buy.”

There are two main seasons for vacation rentals. During the summer, families come up for vacations and enjoy the lakes and rivers and exploring the mountains. In the winter, numerous skiers head to the hills. “From the third week in June (when kids get out of school) through Labor Day” is a booming time, Stellar said. “We start getting busy again when the snow flies around Thanksgiving. That lasts through Easter.”

Who rents?

People come from all over the state and beyond to stay in the cabins and homes in the Arnold area.

“Most people are coming in with two to three families,” Stellar added. “They rent the larger houses. Usually, it’s families. People in their 30s with children ranging from 5 to 13. We get a lot of them from the Bay Area.” Luckily for owners, there are very few younger renters, and the cabins do not receive very much damage. “We don’t get a lot of the 20-somethings up here,” Stellar said. “Almost all of them are families. I really don’t get a lot of damage. I might get a spill on the carpet from kids carrying a Coke. Really, it’s very good.”

Why Arnold?

“People have actually started to discover us,” Stellar said. “We have a whole lot to offer. Once somebody comes up here once, they go home and tell their friends and bring their friends up. Then they come back up year after year. They often use the same cabin every year. It’s kind of a tradition. It’s actually becoming a big draw.”

“If you’re taking a family of five to go skiing and go to Tahoe, you spend a bundle. You can come here instead and spend a lot less.”

“I think it’s more beautiful here,” Stellar said. “It’s a beautiful easy drive from the Bay Area. The people up here are incredibly friendly. There is so much to do. From Murphys all the way up, there is so much diversity.”

Blue Lakes Springs is one of the most popular rental areas because there’s a lot to do within the subdivision.

“Most people are looking for the recreation areas,” Stellar said. “Blue Lakes Springs is very popular because of all the activities they offer. Most families want something for their kids to do.”

This popularity of the vacation rentals has led to home sales rising as well, as some vacationers want a permanent home in the scenic Highway 4 corridor.

Teraoka, has again been named a Super Lawyer of Northern California, recognizing him in the top tier of practicing attorneys in Northern California. Steve recalls that at the age of 13 he already knew that he wanted to be a lawyer with his own firm.

Steves family roots, cultural traditions and natural affinities run deep in both Japan and the United States. In April 1906, after a long and arduous voyage from Japan via Hawaii, his grandfather sailed into the San Francisco Bay in April 1906. The City was still burning from the Great San Francisco Earthquake. Even in flames, the City beckoned as an exotic new home for the Teraokas.

During law school, Steve worked in a prestigious Beverley Hills entertainment law firm. I worked on projects for Robert Mitchum and Toshio Mifune and met Jimmy Durante, to name a few. He also interned for the United States Securities Exchange Commission at its Western Regional Headquarters in Los Angeles. After law school, he studied international tax and business transactions in Japan, and then Steve returned to San Francisco to work for a boutique corporate securities, real estate and tax firm and to pursue the dream of having his own practice in the City By The Bay. In 1976, he opened his own practice in a tiny office on San Franciscos Barbary Coast. There, he could touch both walls with his outstretched arms, and the lunchtime odors of the Clown Alley hamburger shop wafted into his window each day.

Steve admits that when he started his practice, he did not consciously intend to build a Pacific Rim business practice. I really enjoyed interning with the SEC, and I enjoyed doing deals, and wanted to continue work in securities and business transactions.

Like many successful attorneys, Steve has a strong competitive streak. Do not tell him that he cannot win the USTA California District Tennis Championship (his team did, in 2010), or finish a marathon at age 60, and do not tell him that he cannot bust a California monopoly (he did, in 1980). Indeed, a strong driving force in Steves career has been the compunction to succeed against all odds.

Steves penchant for taking on challenges brought him to the forefront of a major effort to deregulate the tour bus industry in San Francisco in the early 1980s. After numerous successful appearances before the PUC obtaining licenses for sight seeing companies, Steve ultimately caught the notice of Japan Travel Bureau, then one of the worlds largest travel agencies. Against all odds, and in spite of the fact that he was the rookie attorney in the courtroom, Steve led the way to win the precedent-setting case that deregulated bus tours and sight seeing operations in California. Ultimately appealed to the California Supreme Court, the ruling favoring Steves clients was allowed to stand.

From that time forward, Steve has consistently earned the respect of many significant Asian business leaders in California and the U.S. Today, his firm has a portfolio of Pacific Rim business clients that are indeed blue chip, including Kikkoman Sales USA, Inc., JFC International, Shogakukan, the Goldilocks Group of Companies, Furukawa Sangyo North America, Nomura Research Institute, and affiliates within the NTT Nippon Telegraph and Telephone Group.

Even stronger than his competitive spirit is Steves talent for helping Japanese business clients to thrive and grow in the United States. He also enjoys counseling American businessmen as to how to best engage with Japanese businesses for mutually beneficial results. In that sense, Steve has always sought to bridge these two cultures, their economies and their commerce.

In 1976, he joined the Japanese Chamber of Commerce of Northern California (JCCNC). In 1994, Steve was elected President of that organization and, as President, welcomed Their Majesties the Emperor and Empress of Japan in their historic Royal Visit to San Francisco. Speaking at the official Welcoming Ceremony for the Emperor and Empress at the St. Francis Hotel, before an audience of over 900 people, was truly one of the great honors and personal highlights of my professional career. He has continued to remain active on the Board of Directors of the JCCNC for over 30 years, seeking to facilitate the successful establishment and growth of Japanese businesses in the U.S.

He has successfully negotiated contracts for American celebrities to endorse Japanese products. Michael K. Ryan Retained as Expert Witness by FDIC

The following were named as their states winners at the annual Farm Bureau Conventions in December. They are now competing for the national award during the American Farm Bureaus annual convention in Hawaii.

Andy Holt Weakley County, Tennessee

The Excellence in Agriculture award recognizes successful young people 35 or younger who are involved in production agriculture, but whose primary occupations are not farming. The award is based on farm involvement as well as participation in Farm Bureau and other community organizations.

We are proud to support young farmers who also support their rural communities not only through farming, but in many ways beyond production agriculture, said George Stebbins, chair of the Board of Directors for FCS. This award is about everything we believe in inspiring young farmers who are successfully finding creative means in upholding the tradition of agriculture and maintaining the values of strong community involvement.

Tracie and Scott Isler Marion County, Ohio

Tracie and Scott Isler raise swine, corn, soybeans and wheat on their Marion County farm, where Scott serves as the swine production manager for the family enterprise. He is also heavily involved in improving swine genetics. Tracie is a second grade teacher, who enjoys integrating agricultural concepts into her curriculum to help her students understand farming.

The Islers are past chairs of Ohio Farm Bureaus Young Agricultural Professionals Advisory Team, graduates of the OFBF AgriPOWER Institute leadership program and have been involved with the Ohio Pork Producers, an assisted living beautification project and student mentor programs. Both are graduates of The Ohio State University.

Julie and Clinton Taylor Boone County, Indiana

Julie and Clinton Taylor along with Clintons parents Tom and Jan farm nearly 4,000 acres of corn, soybeans and wheat. Clintons primary role, in addition to helping with planting and harvest, is incorporating and implementing the use of technology on the farm. He also manages his familys construction business, and Julie is a family and consumer science teacher at Western Boone Jr./Sr. High School.

The Taylors are very involved in their community. Both are members of Dover Christian Church. Julie is the public relations coordinator while Clinton is the secretary/treasurer for Boone County Farm Bureau. Clinton also serves on the Boone County Board of Zoning and Appeals and Julie is the facilitator of the Kiwanis Leadership Academy at School.

Adam Hinton Fleming County, Kentucky

Adam Hinton is vice president of Hinton Mills, a family-owned and operated business that was first opened by Adams great grandfather, Frank L. Hinton, in 1918. The business originated as a general store to serve rural Fleming County but has since transitioned into the farm supply and packaged feed manufacturer Hinton oversees today. Hinton is a member of the Fleming County Farm Bureau, serving on its Young Farmer, Local Affairs and Commodity Feed and Grain Committees, and is involved in numerous civic and industry organizations on both the local and state level.

Andy Holt Weakley, Tennessee

Andy Holt is a graduate of the University of Tennessee at Knoxville with a bachelor of science in Agricultural Economics and Business. He also has a masters degree from the University of Tennessee at Martin. He is married to Ellie Anderson Holt and has three children. They own a diversified ag operation outside Dresden consisting of swine, beef cattle and goats.

In addition to animal production, the Holts are recognized for their annual pumpkin crop and agritourism operation. They are members of Long Heights Baptist Church, the Weakley County Farm Bureau Board of Directors and the Weakley County Young Farmers and Ranchers. MSBA, Americas Military Family Chamber of Commerce, will assist the Alliance with entrepreneurship for military spouses by providing opportunities, support and networking for entrepreneurial spouses to share best practices and experiences for building profitable and portable businesses.

MSBA, with its nearly 1000 military family members, was founded in 2006 by military spouses across the country. MSBA is virtual and supports military spouse entrepreneurs in overcoming the additional odds of building businesses and producing family income, wherever the military assignment may take them. Business ownership provides financial stability for active duty military families and a bridge to families of veterans.

On January 13, the MSBA will be part of the U.S. Chamber of Commerce Military Spouse Career Forum at the Convention Center in Washington, D.C. Over 1,000 spouses are expected to attend from one of the most densely populated military communities in the nation. The event is the nation’s largest career fair dedicated exclusively to military spouses. At the event, the MSBA is available to military spouse entrepreneurs who will be present to encourage those who desire to start or build their own businesses.

MSBA estimates 10% of military families either want or already own their own business, which is usually run by the spouse. There are all types – professional consultants, photographers, real estate agents, and product-based; but they share one thing – they have to be portable and flexible as military families move, on average, once every three years.
